Abuse of Students by District Employees
Physical or sexual abuse of students, including inappropriate and intentional sexual behavior, by employees will not be tolerated. The definition of employees for the purpose of this policy includes not only those who work for pay but also those who are volunteers of the school district under the direction and control of the school district.
Employees found in violation of this policy will be subject to disciplinary action up to and including discharge.
The school district will respond promptly to allegations of abuse of students by school district employees by investigating or arranging for the investigation of an allegation. The processing of a complaint or allegation will be handled confidentially to the maximum extent possible. Employees are required to assist in the investigation when requested to provide information and to maintain the confidentiality of the reporting and investigation process.
The school district has appointed a Level I investigator and an alternate Level I investigator. The school district has also arranged for a trained, experienced professional to serve as the Level II investigator. The Level I investigator and alternate will be provided training in the conducting of an investigation at the expense of the school district. The names of the investigators shall be listed in the student handbook, published annually in the local newspaper, and posted in all school facilities.
Affirmation of Board Support of District Policies
The Lewis Central Community School Board affirms its intent to support discipline policies, its intent to support school staff who enforce the discipline policies, and its intent to hold school staff accountable for implementing the discipline policies.
Asbestos
The Asbestos Hazard Emergency Response Act (AHERA) was introduced in 1986 and was designed to determine the extent of asbestos in school buildings and to act as a guide in formulating asbestos management policies for schools.
The High School, completed in 2001, was built using asbestos-free building materials. The Middle School renovation project started with asbestos abatement in 2002 and is now asbestos-free. Titan Hill was inspected and found clear of asbestos. Kreft Primary is still under the asbestos management plan. With future renovation plans, this facility could become asbestos-free in the future.
The District asbestos management plan is in place to monitor containing low-risk levels of asbestos. The asbestos management plan is located in each building office and at the Operations Building, 1600 E.S. Omaha Bridge Road, Council Bluffs, Iowa. Corporal Punishment, Restraining, and Physical Confinement and Detention
State law forbids school employees from using corporal punishment against any student. Certain actions by school employees are not considered corporal punishment. Additionally, school employees may use "reasonable and necessary force, not designed or intended to cause pain" to do certain things, such as prevent harm to persons or property.
State law also places limits school employees' abilities to restrain or confine and detain any student. The law limits why, how, where, and for how long a school employee may restrain or confine and detain a child. If a child is restrained, or confined and detained, the school must maintain documentation and must provide certain types of notice to the child's parent.
Dispensing of Medication
Some students may need prescription and nonprescription medication to participate in their educational program. These students shall receive medication associated with their educational program.
Medication shall be administered when the student’s parent or guardian (hereafter “parent”) provides a signed and dated written statement requesting medication administration at school, and the medication is in the original labeled container, either as dispensed or in the manufacturer’s container.
When administration of the medication requires ongoing professional health judgment, an individual health plan shall be developed by the licensed health personnel with the student and the student’s parent. Students who have demonstrated competence in administering their own medications may self-administer their medication. A written statement by the student’s parent shall be on file requesting co-administration of medication, when competence has been demonstrated.
Persons administering medication shall include the licensed registered nurse, parent, physician, and persons who have successfully completed a medication administration course reviewed by the Board of Pharmacy Examiners. A medication administration course and periodic update shall be conducted by a registered nurse or licensed pharmacist, and a record of course completion kept on file at school.
A written medication administration record shall be on file at school, including: date; student’s name; prescriber or person authorizing administration; medication; medication dosage; administration time; administration method; signature and title of the person administering medication; and any unusual circumstances, actions, or omissions.
Medication shall be stored in a secured area unless an alternate provision is documented.
Emergency protocols for medication-related reactions shall be posted.
Medication information shall be confidential information and shall be available to school personnel with parental authorization.
Dissemination of Comprehensive Policies
Federal and state regulations require that the nondiscrimination policy, the identity, address, and phone number of the local educational equity coordinators and notification about the existence of the grievance procedure be disseminated annually, or on an on-going basis to students, parents, employees, applicants for employment, and unions or professional organizations holding collective bargaining agreements with the school. This information must be included in major annual publications or formal communications targeted at these groups, such as student handbooks, teacher and employee handbooks, registration handbooks, and program and recruitment brochures.
Field Trips
Field trips are excellent educational opportunities for students and staff, and we are fortunate to have so many options within a reasonable distance.
Due to the number of regularly scheduled events, the lack of available drivers, and the increasing number of conflicts, we must implement some restrictions relative to field trips. Field Trips may not be scheduled during the first two weeks of school or after the second Friday in May.
Free and Reduced Lunch
Free or reduced-cost meals shall be provided to those students whose parents or guardians are unable to pay for the cost of the meals, subject to the requirements of the Federal Lunch Program. Application forms are available in the Cafeteria Office.
Homeless Students

Human Growth and Development
The school shall provide instruction in Human Growth and Development, including instruction regarding Human Sexuality, Self-Esteem, Stress Management, Interpersonal Relationships, and Acquired Immune Deficiency Syndrome (AIDS). Parents may inspect the curriculum objectives and instructional materials prior to their use in the classroom.
A pupil shall not be required to take instruction in Human Growth and Development if the pupil’s parent or guardian completes a “Human Growth and Development Student Excuse Form.” This form is available through the Principal’s Office and must be filed there upon completion.
Immunization Record
Iowa law requires that every student in the Lewis Central Community School District have certain immunizations prior to school enrollment. If we do not have the proper certificate on file for your child prior to the first day enrolled, we have no choice but to deny him/her from enrolling. In most cases, all former students have this certificate on file with the school. However, all new students wishing to enroll must have such certification of immunization, as well as any transfer students.
Lockers
Student lockers are the property of the school district. Students shall use the lockers assigned to them by the school district for storing their school materials and personal belongings necessary for attendance at school. It shall be the responsibility of students to keep their assigned lockers clean and undamaged.
The Lewis Central Community School District has adopted changes to its Search and Seizure and Student Lockers policies. These changes are consistent with Chapter 808A of the Iowa Code, the Iowa Constitution, and the United States Constitution. These changes allow school officials (meaning licensed school employees and unlicensed school employees employed for security or supervision purposes) to conduct periodic inspections of all or a randomly selected number of school lockers without prior notice.
Any periodic inspection of lockers pursuant to District policy shall only occur either in the presence of the student(s) whose lockers are being inspected or in the presence of at least one other person. A locker inspection may be accomplished using such methods, including, but not limited to, a visual search of lockers by school officials or the use, by school officials or others hired at their direction, or a drug-sniffing animal.

Open Enrollment
Parents/Guardians considering the use of the Open Enrollment option to enroll their child(ren) in another public school district in the state of Iowa should be aware of the following dates:
- March 1 is the deadline for regular Open Enrollment requests for the following school year for students entering grades 1-12.
- The open enrollment deadline for students in kindergarten is September 1.
- Preschool students do not qualify for open enrollment.
If the student meets the definition of good cause under 281-Iowa Administrative Code 17.4(1) because of a change in residence or is a kindergarten student, the application can be accepted after March 1.
A pupil who transfers school districts under open enrollment in grades 9 through 12 shall not be eligible to participate in interscholastic contests and competitions during the first 90 school days of transfer.
Parents/Guardians of Open Enrolled students whose income falls below 160% of the Federal Poverty Guidelines are eligible for transportation assistance. This may be in the form of actual transportation or in the form of a cash stipend.

Release of Information and Photographs
In the Lewis Central Community School District, photographs or likeness’ may be released without written consent unless qualified objectors comply with the following procedure.
If any parent or guardians of students under the age of 18, or students over the age of 18, object to this policy of releasing photographs or likenesses, they should contact in writing by September 15, of the current year (or within two weeks of the student’s enrollment should it occur after this date), the superintendent who will then notify the appropriate school principal. Student Directory Information
The District and/or the principal of each school may release the following types of directory information to the public using discretion relative to the privacy of the student and the family and the totality of the surrounding circumstances: name, address, telephone listing, date and place of birth, major field of study, participation in officially recognized activities and sports, weight and height of members of athletic teams, dates of attendance, degrees and awards received, and the most previous school or institution attended by the student.
Parents who do not want their child’s directory information to be given out and/or published must notify their principal in writing no later than September 15 of each school year.
Student Records Policy
The board recognizes the importance of maintaining education records and preserving their confidentiality as provided by law. Education records are kept confidential at the collection, storage, disclosure, and destruction stages. The board secretary is the custodian of education records. Education records may be maintained in the central administration office or the administrative office of the student's attendance center.
Teacher Qualifications
Parents/Guardians in the Lewis Central Community School District have the right to learn about the following regarding the professional qualifications of their students' classroom teachers:
- state licensure status,
- special endorsements for grade level/subject area taught,
- baccalaureate/graduate certification/degree,
- whether the child is provided assistance by a paraprofessional and, if so, his/her qualifications.

The Lewis Central Community School District ensures that parents will be notified in writing if their child has been assigned, or has been taught by a teacher for four or more consecutive weeks, by a teacher who is not considered highly qualified.
Water Testing
The Iowa Department of Public Health requires school districts to conduct testing of all water coolers and fountains for lead-containing sediments. The Lewis Central School District has completed the required testing of all district water coolers and fountains. All water dispensers have been identified below 20 PUB (0.020 Mg/Liter), as required by law.
